EFEKTIFITAS SANKSI PIDANA TERHADAP PELANGGARAN LALU LINTAS JALAN
Abstract
The purpose of the study is: To find out about the appropriate criminal penalties to be applied to traffic violations and the elements that influence the success of criminal penalties for road traffic violations. The approach used in this study is the normative method, also known as doctrinal legal research, or literature study. The research findings show that the elements that influence the effectiveness of imposing criminal sanctions are also influenced by the judge's discretion based on a sense of humanity where the economic situation and social status of the offender and the quality of the act/qualification factor (light, heavy and moderate) and the violations committed by road users are the main considerations in imposing sanctions.
