PERAN DAN KEWENANGAN BAWASLU DALAM MENEGAKKAN DEMOKRASI BERBASIS HUKUM DI INDONESIA
Abstract
The Election Supervisory Board (Bawaslu) plays a crucial role in upholding law-based democracy in Indonesia, particularly in overseeing and preventing election violations. According to Law No. 7 of 2017, Bawaslu is granted broader authority, including resolving administrative disputes and election violations that were previously under the authority of the General Election Commission (KPU). With this authority, Bawaslu is responsible for ensuring that elections are conducted freely, fairly, and transparently in accordance with applicable regulations, and for taking firm action against any violations that may undermine the integrity of the elections. However, challenges in implementing this authority remain significant, particularly concerning limitations in human resources, budget, and coordination between agencies. Therefore, the effectiveness of Bawaslu in upholding law-based democracy heavily depends on strengthening institutional capacity, updating regulations, and fostering active public participation in election oversight.
