POLITIK HUKUM TINDAK PIDANA PEMBAKARAN HUTAN DAN LAHAN (Penegakan Hukum Pidana Lingkungan Hidup di Indonesia)
Abstract
In the future, the legal policy of forest and land burning crimes must stipulate that forest burning must be completely prohibited without reason, especially complete forest burning, because even the smallest forest burning can cause great harm to the environment, public health, and neighboring countries. The government must review Article 69 paragraph (2) of the PLH Law 09 by conducting a legal review to prohibit forest burning. This article allows forest burning on land with a maximum area of 2 ha. This can also be a legal loophole for the issuance of derivative laws and regulations that legalize certain reasons that allow forest burning.
