ANALISIS YURIDIS PERLINDUNGAN HUKUM TENAGA KERJA OUTSOURCING
Abstract
This study analyzes the legal protection of outsourced workers and outsourcing work agreements under the Job Creation Law and its implementing regulations. The research focuses on the implementation of the law, particularly regarding the limitations on the types of work that can be outsourced, the rights of outsourced workers, and the provisions of outsourcing work agreements. The research method uses a normative juridical approach by analyzing laws and regulations, court decisions, and related literature. The results show significant changes in the legal protection of outsourced workers following the enactment of the 2023 Job Creation Law. However, its implementation still faces challenges, particularly related to oversight and law enforcement. This study recommends increased oversight and dissemination of the Job Creation Law to all stakeholders to ensure the effective protection of outsourced workers' rights. This study also highlights the importance of drafting fair and transparent outsourcing work agreements to prevent potential labor exploitation.
