GOLOK BANTEN, DILEMA KOMERSIALISASI BUDAYA DALAM PERSPEKTIF HUKUM KEKAYAAN INTELEKTUAL DAN DAGANG
Abstract
This study discusses the dilemma between cultural preservation and economic interests in the commercialization of the Banten Golok from a commercial law perspective. The Banten Golok is not only a traditional tool, but also a symbol of identity, honor, and spirituality for the people of Banten. This study aims to determine the commercial law regulations in Indonesia and protect cultural commercialization, as well as to identify effective legal strategies in balancing economic interests and cultural preservation regarding the commercialization of the Banten Golok. This study uses a qualitative method with an empirical juridical approach. The data used are primary, secondary, and tertiary data, while the data analysis is descriptive and analytical. The results of the study show that legal regulations such as the Trade Law, Copyright Law, Geographical Indications Law, and Intellectual Property Law have provided a legal basis, but their implementation is still weak. More concrete legal strategies are needed through the application of Geographical Indications, the establishment of collective brands, and the strengthening of artisan cooperatives. Synergy between the government, craftsmen, and legal institutions is key to ensuring that the Banten Golok remains legally protected, economically valuable, and preserved in its authenticity as a cultural heritage of the Banten community.
