Abstract

The development of information and communication technology has significantly transformed the governance of personal data in the digital era. The increasing intensity of public digital activities has created substantial risks of personal data misuse and data breaches, thereby necessitating comprehensive legal protection. Indonesia has enacted Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) as an effort to strengthen cyberlaw regulations in the field of personal data protection. This study aims to analyze the comparison between Indonesia’s personal data protection regulations and international standards, particularly the European Union’s General Data Protection Regulation (GDPR). The research employs a normative juridical method using statutory and comparative approaches. The findings indicate that Indonesia’s PDP Law has several international principles, including data subject consent, data subject rights, and obligations of data controllers. Nevertheless, several weaknesses remain, such as the absence of an optimal independent supervisory authority, insufficient regulation regarding cross-border data transfers, and the limited implementation of the privacy by design principle. Therefore, the harmonization of national regulations with international standards is essential to enhance legal certainty and the protection of citizens’ privacy rights in cyberspace.
